General Terms and Conditions
1. Introductory provisions
The General Terms and Conditions of Business (hereinafter referred to as "GTC") of the natural person Leo Bartoš, with registered office at Horečky 861, Frenštát pod Radhoštěm, 744 01, ID No.: 11180366, registered in the Trade Register No. OŽV/1703/2008/Lac/2 (hereinafter referred to as "Provider"), regulate the general rights and obligations between the Provider and the natural or legal person who orders services from the Provider (hereinafter referred to as "Client").
The Provider's premises covered by these GTC:
- Hotel Bartoš, Školská čtvrt' 1393, Frenštát pod Radhoštěm, 74401 (hereinafter referred to as "HB") https://hotelbartos.cz/.
The GTC apply to the legal relations between the Client and the Provider in the provision of services and to other legal relations derived from these relations. By using the services, the Client agrees to these GTC and undertakes to comply with them.
The GTC, as well as the legal relations between the Provider and the Client, are governed by generally binding legal regulations of the Czech Republic, in particular Act No. 89/2012 Coll., the Civil Code, as amended. If the Client is a consumer, these legal relations are also governed by Act No. 634/1992 Coll., on Consumer Protection, as amended.
2. Definition of terms
2.1. The Client is a person who makes a reservation by any of the methods specified in paragraph 3 of these GTC. The person of the Client does not have to be the same as the person of the Guest.
2.2. The Guest is the person who is the final recipient of the booked stay and/or the Provider's services (hereinafter referred to as "Guest"). In the event that the Client is also a Guest, he/she is referred to only as the Client.
2.3. The reservation system is the reservation system operated by the Provider, in particular on the website www.hotelbartos.cz (hereinafter referred to as the "System"), which enables the online reservation of stays and/or services offered by the Provider according to the current available capacities via a form.
2.4. Individual reservations are valid for bookings from 1 to 10 rooms, and are valid only for services related to accommodation. These reservations are handled by the Provider's reception.
2.5. Group bookings are valid for bookings of 11 rooms or more and for groups requiring additional services. Additional services are meant for example catering, reservation of conference rooms and common areas, rental of conference equipment, ordering teambuilding activities, etc. These reservations are managed by the Provider's sales department.
3. Booking conditions
The Client orders individual services from the Provider via e-mail sent to the following addresses:
- For individual bookings: info@hotelbartos.cz.
- For group bookings: info@hotelbartos.cz.
- In case of accommodation at Hotel Bartoš also via the Provider's reservation system: https://hotelbartos.cz/.
3.1. For individual bookings, the Client receives a Preliminary Booking Confirmation, which is an offer of stay issued by the Provider and does not entitle the Client to use the offered stays and/or services. The Preliminary Booking Confirmation contains information about the Client (name, surname, email address), Guest(s) (name, surname, date of birth), the stay and/or services booked (length of stay, date of stay, type of stay, hotel name, room category - option term, payment and cancellation terms. The Client is obliged to double-check the accuracy of the information provided. The validity of the Provisional Booking Confirmation expires upon expiry of the option period specified in the Provisional Booking Confirmation.
3.2. In the case of a group booking, the Client receives a Provisional Booking Confirmation in the form of a Price Offer, which does not entitle the Client to use the offered stays and/or services. The Provider may specify an option period for the services offered, which is set out in the Price Offer and during which the conditions set out in the Price Offer apply. After the expiry of this option period, the Provider is entitled to cancel the Preliminary Booking without giving any reason and the terms and conditions set out in the Price Offer shall cease to be valid.
3.3. The Client's acceptance of the Preliminary Reservation/Price Offer constitutes a proposal to conclude the Provider's Services Sale Agreement.
3.4. The binding confirmation of the individual reservation (hereinafter also referred to as the "Contract") issued by the Provider entitles the Customer to use the reserved stays and/or services, provided that the payment terms are complied with. The Contract contains information about the Client (name, surname and e-mail address), the Guest(s) (name, surname, e-mail address), the booked stay and/or services (length of stay, date of stay, type of stay, name of the hotel, room category - if included in the offer, type of meals, any services included in the stay), the total price of the stay and/or services and information about payment. The client is obliged to check the accuracy of the information provided. In case of any discrepancy, the Client shall immediately contact the Provider at the following e-mail address: info@hotelbartos.cz.
3.5. The binding confirmation of the group booking/price offer (hereinafter also referred to as "Contract") issued by the Provider entitles the Client to use the booked stays and/or services, provided that the payment conditions are met. The Contract contains information about the Client (name, surname and e-mail address), the booked stay and/or services (length of stay, date of stay, type of stay, name of the hotel - if included in the offer, type of meals, all services included in the stay), the total price of the stay and/or services and information about payment. The client is obliged to check the accuracy of the information provided. If any discrepancy is found, the Client shall immediately contact the Provider at the e-mail address of the Price Offer processor, namely: info@hotelbartos.cz.
3.6. The rights and obligations of the Parties not expressly provided for in the Contract are governed by these GTC and the Provider's price list of services. If the Contract stipulates something different from these GTC or the price list of the accommodation provider, the Contract shall apply. If the Client fails to comply with the obligations arising from the Contract and the GTC, the accommodation provider is entitled to terminate the Contract before the expiry of the agreed period, even without notice.
4. Payment terms
4.1
When making a binding reservation, the Provider may require the Client to pay a deposit of any amount of the total price specified in the Contract. Based on the billing information provided by the Client, a proforma deposit will be sent to the Client, payable before the commencement of the accommodation. If the deposit is not paid by the due date, the Provider reserves the right to withdraw from the Contract.
If the due dates of the advance payment are not specified in the Contract issued by the Provider, the following shall apply:

- For individual stays, the Client may be required to make a 100% pre-payment. This is the case for standard offers as well as for discounted stays and stays on special calendar days. The Provider reserves the right to change special calendar days during the year. The amount is payable within the period stated on the proforma invoice.
- The decision as to whether or not a stay is discounted is entirely at the discretion of the Provider.
- Bookings made through third parties are subject to the terms and conditions of the individual entity with which the booking was made. In the case of payment on the spot, the full amount must be paid no later than the day of the Guest's departure.
- Payment for the stay through the Client's employer or by gift voucher/voucher is only possible through the Provider and its booking systems. It cannot be made through third parties or external entities. The final invoice will be issued no later than the day of the Guest's departure.
4.3. Taxes, fees, levies
The applicable prices do not include the city tax of 20 CZK per adult. This fee is added to the agreed price, based on the actual number of persons staying.
In the event that there is a change in tax rates, fees and charges that were not previously known to the contracting parties, the Provider is obliged to adjust the prices accordingly.
4.4. Means of payment
Valid means of payment are: cash in CZK and credit cards: MasterCard, Visa, Maestro and American Express.
The hotel does not operate an exchange office.
5. Cancellation policy
5.1. Cancellation of individual reservations
- In case of 100% prepayment, the cancellation fee is 100% of the booked amount in case of early booking offer and other special offers.
- In the case of payment by gift certificate, the cancellation fee is 100% of the amount booked.
- Cancellation terms for stays booked through online travel portals are subject to the cancellation terms of these individual entities.
5.2. Cancellations for group bookings
The cancellation fee for cancellation of the entire event is calculated individually based on the offer.
6. Duration of use of the booked rooms
Reserved hotel rooms are available from 14:00 on the day of arrival and until 10:00 on the day of departure.
Hotel check-in can only be done physically at the HB reception.
It is the Guest's responsibility to prove that no or significantly less damage has been incurred by the Provider. In case the Provider has already booked the room for another Client and the Guest does not vacate the room despite being notified or is not present at the HB, the Provider reserves the right to take the Guest's belongings and store them in a safe place so that the room can be used by the next Client who has booked it.
Arrival
Upon arrival, the Guest shall present his/her identity document. In the event of failure to present valid documents, the Provider is entitled not to accommodate the Guest.
The number of persons in the room corresponds to the number of persons registered for accommodation. The Client is obliged to declare the exact number of guests upon check-in at the reception.
The period of accommodation is agreed upon at the latest upon the Guest's accommodation and is recorded in the hotel's PMS system. The accommodation period can be extended only with the consent of the Provider.
Upon check-in, the Guest receives an access card and is obliged to prevent its loss, destruction or damage, as well as its access to third parties who are not a direct party to the Contract. In case of loss of the access card, the Client is obliged to report the loss to the receptionist.
By staying at the hotel, the Guest confirms that he/she has been informed, understands and will abide by the GTC and the operating rules of each section, which are available upon request. In the event of a breach of these, the Provider has the right to withdraw from the Contract before the expiry of the agreed period, without any obligation to pay any damages to the Guest.
By requesting accommodation, but no later than by concluding the Contract, the Client gives consent to the Provider to process and store his/her personal data within the scope of the data provided, for the purpose of providing accommodation services and keeping records of guests within the meaning of Act No. 565/1990 Coll., on local fees, and Act No. 326/1999 Coll., on the residence of foreigners in the territory of the Czech Republic. The processing of personal data is done in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR) and Act No. 110/2019 Coll., on the processing of personal data.
Guests under 18 years of age will be accommodated only as an accompanying adult.
If the Guest is under the influence of alcohol or drugs, the Provider has the right to prevent the Guest from entering the hotel and providing services. If the Guest is obviously under the influence of alcohol or drugs and his/her behaviour could endanger the safety or comfort of other guests, the Hotel reserves the right to refuse to provide services.
Accommodation Regulations
The hotel can only accommodate a guest who has been properly checked in. For this purpose, the guest shall present his/her ID card, valid passport or other valid proof of identity to the hotel upon arrival. A guest who is a permanent resident of the hotel can also be accommodated.
The hotel shall provide services to guests within the scope of the relevant industry standard in the specified class.
In special cases, the hotel may offer the guest accommodation other than the agreed accommodation, provided that it does not differ substantially from the confirmed order.
The hotel is obliged to accommodate the guest by 7:00 p.m. at the latest on the basis of the ordered accommodation - the hotel will reserve the room for the guest by this time, unless otherwise specified in the order.
If the guest has booked a single room in advance and the booking has been confirmed, the hotel will charge the guest only the price for a single room even if the guest is staying in a multi-bed room or suite. This principle also applies to the booking and confirmation of a double room or triple room if the guest is staying in a multi-bedded room or suite.
If the guest requests an extension, the hotel may offer him/her a room other than the one in which he/she was originally accommodated.
The hotel shall be liable both for items brought into the hotel by the guest and for damage to the items left behind, provided that they are left in a place reserved for that purpose or where they are usually stored. The hotel is not liable for money and valuable items; the safes in the rooms and reception are used for this purpose.
There are common rooms for receiving visitors. Guests can only receive visitors in the room with the permission of the hotel staff after entering their name in the guest book between 8:00 and 22:00.
In case of illness or injury, the hotel will provide medical assistance or transport to hospital.
The guest uses the room for the period agreed with the hotel. If the accommodation period has not been agreed in advance, the guest shall check out no later than 11:00 on the last day and vacate the room at the same time. If the guest fails to do so within the time limit, the hotel may charge the guest for the following day's stay.
The hotel premises are completely non-smoking, including electronic cigarettes and other similar devices. Violation of this prohibition will result in property damage and a fine.
Gift vouchers, vouchers
Purchased vouchers/vouchers are non-refundable and are valid only for the period of validity and for the services listed on them. The provider accepts only gift vouchers/vouchers issued by the provider and bearing a numerical code. The client has the right to use the services in the agreed amount. Gift vouchers/vouchers are subject to the booking conditions in paragraph 3 of these GTC. The Client is obliged to inform the Provider of the intention to pay for the stay and services by means of a gift voucher/voucher, in writing and before the conclusion of the Contract.
HB Wellness Centre
The Guest is obliged to follow the Provider's wellness centre operating and visiting rules.
Reception service
The reception service at HB is available 24 hours a day.
Cleaning services
During stays, the Guest is entitled to room cleaning.
Final arrangements
The Provider reserves the right to amend these GTC, such amendment being effective for all parties from the date of their posting on the Hotel's website www.hotelbartos.cz.
Legal relations as well as other matters not expressly regulated by these Accommodation Regulations shall be governed by the applicable laws of the Czech Republic and other internal regulations of the Hotel.
The consumer has the right to an out-of-court settlement of a consumer dispute arising from the contract through the Czech Trade Inspectorate (www.coi.cz).
These GTC come into force on 1.1.2016.
