General Terms and Conditions
1. Introductory Provisions
The General Terms and Conditions (hereinafter referred to as the “GTC”) of the natural person Leo Bartoš, with its registered office at Horečky 861, Frenštát pod Radhoštěm, 744 01, ID: 11180366, entered in the Trade Register under the number OŽV/1703/2008/Lac/2 (hereinafter referred to as the “Provider”), govern the general rights and obligations between the Provider and the natural or legal person who orders services from the Provider (hereinafter referred to as the “Client”).
The Provider’s establishments to which these GTC apply:
Hotel Bartoš, Školská čtvrť 1393, Frenštát pod Radhoštěm, 74401 (hereinafter referred to as the “HB”) https://hotelbartos.cz/.
The GTC apply to the legal relations between the Client and the Provider when providing services and to other legal relations derived from these relations. By using the services, the Client agrees to these GTC and undertakes to comply with them.
The GTC, as well as the legal relations between the Provider and the Client, are governed by generally binding legal regulations of the Czech Republic, in particular Act No. 89/2012 Coll., the Civil Code, as amended. If the Client is a consumer, these legal relations are also governed by Act No. 634/1992 Coll., on Consumer Protection, as amended.
2. Definitions
2.1. The Client is a person who makes a reservation in any of the ways specified in paragraph 3 of these GTC. The Client does not have to be the same as the Guest.
2.2. The Guest is a person who is the final recipient of the reserved stay and/or services of the Provider (hereinafter referred to as the “Guest”). If the Client is also a Guest, he is referred to only as the Client.
2.3. The reservation system is the reservation system operated by the Provider, in particular on the website www.hotelbartos.cz (hereinafter referred to as the “System”), which allows, via a form, online reservation of stays and/or services offered by the Provider according to current available capacities.
2.4. Individual reservations apply to reservations from 1 to 10 rooms, and apply only to services related to accommodation. These reservations are handled by the Provider’s reception.
2.5. Group reservations apply to reservations of 11 or more rooms and for groups requiring additional services. Additional services include catering, reservations of conference rooms and social areas, rental of conference equipment, ordering teambuilding activities, etc. These reservations are managed by the Provider’s sales department.
3. Reservation conditions
The Client orders individual services from the Provider via e-mail sent to the following addresses:
- For individual reservations: info@hotelbartos.cz.
- For group reservations: info@hotelbartos.cz.
- In the case of accommodation at the Hotel Bartoš also through the Provider's Reservation System: https://hotelbartos.cz/.
3.2. In the case of a group reservation, the Client receives the preliminary reservation confirmation in the form of a Price Offer, which does not entitle the Client to use the offered stays or services. The Provider may determine an option period for the offered services, which is specified in the Price Offer and during which the conditions specified in the Price Offer apply. After the expiration of this option period, the Provider is entitled to cancel the preliminary reservation without giving a reason and the conditions specified in the Price Offer cease to be valid.
3.3. Approval of the preliminary reservation/Price Offer by the Client represents a proposal to conclude a Contract for the sale of the Provider's services.
3.4. The binding confirmation of an individual reservation (hereinafter also the "Contract") issued by the Provider authorizes the use of the reserved stays and/or services, however, only subject to compliance with the payment terms. The Contract contains information about the Client (name, surname and e-mail address), Guest/Guests (name, surname, e-mail address), the reserved stay and/or services (length of stay, date of stay, type of stay, hotel name, room category - if included in the offer, type of catering, all services included in the stay), the total price of the stay and/or services and information about payment. The Client is obliged to check the accuracy of the specified data. If any discrepancy is detected, the Client shall immediately contact the Provider at the e-mail address: info@hotelbartos.cz.
3.5. The binding confirmation of a group reservation/price offer (hereinafter also the “Agreement”) issued by the Provider authorizes the use of the reserved stays and/or services, however, only provided that the payment conditions are met. The Agreement contains information about the Client (name, surname and e-mail address), the reserved stay and/or services (length of stay, date of stay, type of stay, name of the hotel – if included in the offer, type of catering, all services included in the stay), the total price of the stay and/or services and information about payment. The Client is obliged to check the accuracy of the specified data. If any discrepancy is found, the Client shall immediately contact the Provider at the e-mail address of the processor of the Price Offer, namely: info@hotelbartos.cz.
3.6. The rights and obligations of the contracting parties not expressly regulated by the Agreement are regulated by these GTC and the price list of the Provider’s services. If the Contract stipulates something different from these GTC or the price list of the accommodation provider, the Contract shall apply. If the customer fails to comply with the obligations arising from the Contract and the GTC, the accommodation provider is entitled to terminate the Contract before the expiry of the agreed period, even without a notice period.
4. Payment terms
4.1. Deposit
In the case of a binding reservation, the Provider may request from the Client a deposit of any amount of the total price specified in the Contract. Based on the billing information provided by the Client, a deposit proforma payable before the start of accommodation will be sent to him. If the deposit is not paid by the due date, the Provider reserves the right to withdraw from the Contract.
If the due dates of the deposit are not specified in the Contract issued by the Provider, the following applies:
4.2. Deposit for individual reservations
- For individual stays, the Client may be required to make a 100% pre-payment. This applies to both standard offers and discounted stays and stays on special calendar days. The Provider reserves the right to change special calendar days during the year. The amount is payable within the period specified on the proforma invoice.
- The decision as to whether or not it is a discounted stay is entirely within the competence of the Provider.
- Reservations made through third parties are governed by the terms and conditions of the individual entities with which the reservation was made. In the case of payment on site, the full amount must be paid no later than the day of the Guest's departure.
- Payment for the stay through the Client's employer or by gift certificate/voucher is only possible through the Provider and its reservation systems. It cannot be done through third parties or third-party entities. The final invoice will be issued no later than the day of the Guest's departure.
4.3. Taxes, fees, levies
The applicable prices do not include the city fee of 20 CZK per adult. This fee is added to the agreed price, based on the actual number of accommodated persons.
In the event of a change in tax rates, fees and levies that were not yet known to the contracting parties, the Provider is obliged to adjust the prices accordingly.
4.4. Payment methods
The valid payment methods are: cash in CZK and payment cards: MasterCard, Visa, Maestro and American Express.
The hotel does not operate a currency exchange office.
5. Cancellation conditions
5.1. Cancellation of individual reservations
- In the case of 100% pre-payment, the cancellation fee is 100% of the reserved amount in the case of using the early booking offer and other offers on special dates.
- In the case of payment via a gift certificate, the cancellation fee is 100% of the reserved amount.
- Cancellation conditions for stays booked via online travel portals are governed by the cancellation conditions of these individual entities.
5.2. Cancellation of group reservations
The amount of the cancellation fee when canceling the entire event is calculated individually based on the offer.
Period of use of reserved rooms
Reserved hotel rooms are available from 2:00 p.m. on the day of arrival and until 10:00 a.m. on the day of departure.
Registration for hotel accommodation can only be done physically at the HB reception.
It is up to the Guest to prove that the Provider has not incurred any or significantly less damage. In the event that the Provider has previously reserved this room for another Client and the Guest does not vacate the room despite notification or is not present at the HV, the Provider reserves the right, with the participation of a two-member commission, to write down the Guest's belongings and store them in a safe place so that the room can be used by another Client who has reserved it.
Arrival
Upon arrival, the Guest shall present his/her identity document. In the event of failure to present the above valid documents, the Provider is entitled to refuse to accommodate the Guest.
The number of persons in the room corresponds to the number of persons registered for accommodation. The Client is obliged to report their exact number when checking in at the reception.
The period of accommodation is agreed upon at the latest when the Guest is accommodated and is recorded in the hotel's PMS system. The period of accommodation may only be extended with the consent of the Provider.
When checking in to the accommodation, the Guest receives an access card and is obliged to prevent its loss, destruction or damage, as well as its disclosure to third parties who are not direct parties to the Contract. If the access card is lost, the Client is obliged to report this loss to the receptionist.
By staying at the hotel, the Guest confirms that he/she has read, understood and will comply with the GTC and the operating rules of the individual sections, which are available upon request. In the event of their violation, the Provider has the right to withdraw from the Contract before the expiry of the agreed period, without any obligation to pay the Guest any damages.
By requesting accommodation, but no later than by concluding the Contract, the Client grants the Provider consent to the processing and storage of his/her personal data to the extent of the data provided, for the purpose of providing accommodation services and keeping records of guests within the meaning of Act No. 565/1990 Coll., on local fees, and Act No. 326/1999 Coll., on the stay of foreigners in the Czech Republic. The processing of personal data is carried out in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR) and Act No. 110/2019 Coll., on the processing of personal data.
Guests under the age of 18 will only be accommodated as companions of an adult person being accommodated.
If the Guest is under the influence of alcohol or narcotics, the Provider has the right to prevent him from entering the hotel and providing services. If the Guest is clearly under the influence of alcohol or narcotics and his behavior could endanger the safety or comfort of other guests, the hotel reserves the right to refuse to provide services.
Accommodation Rules
1. The hotel may only accommodate a guest who has been duly registered. For this purpose, the guest shall present his identity card, valid passport or other valid identification document to the hotel employee immediately upon arrival. It is also possible to accommodate a guest who has permanent residence in the hotel.
2. The hotel provides services to accommodated guests to the extent determined by the relevant industry standard in the specified class.
3. In special cases, the hotel may offer the guest accommodation other than the agreed accommodation, if it does not differ substantially from the confirmed order.
4. Based on the booked accommodation, the hotel is obliged to accommodate the guest no later than 7:00 p.m. - by this time it will also reserve a room for the guest, unless otherwise specified in the order.
5. If the guest has booked a single room in advance and the order has been confirmed, the hotel will only charge the guest the price for a single room, even if the guest is accommodated in a multi-bed room or suite. This principle also applies to the booking and confirmation of a double room or triple room, if the guest is accommodated in a multi-bed room or suite.
6. If the guest requests an extension of their stay, the hotel may offer them a room other than the one in which they were originally accommodated.
7. The hotel is liable for items brought into the hotel by the guest and for damage to items left behind, if these items were left behind in the designated place or where they are usually stored. The hotel is not responsible for money and valuables; safes located in the rooms and at the reception are used for this purpose.
8. Communal rooms are available for receiving visitors. Guests may receive visitors in their rooms only with the consent of the relevant hotel employee after registering in the guest book between 8:00 and 22:00.
9. The hotel will ensure that medical assistance is provided or that the guest is transported to the hospital in the event of illness or injury.
10. The guest uses the room for the period agreed upon with the hotel. If the accommodation period has not been agreed in advance, the guest will check out of the room no later than 11:00 on the last day and will vacate the room at the same time. If the guest does not do so within the specified period, the hotel may charge the guest for the following day's stay.
Gift vouchers, vouchers
Purchased vouchers/vouchers are non-refundable and are valid only for the period of validity and for the services stated on them. The Provider accepts only gift vouchers/vouchers issued by it and provided with a numerical code. The Client has the right to use the services in the agreed amount. The reservation conditions from paragraph 3 of these GTC apply to gift vouchers/vouchers. The Client is obliged to inform the Provider of the intention to pay for the stay and services via a gift voucher/voucher, in writing and before concluding the Contract.
HB Wellness Center
The Guest is obliged to follow the operating and visiting rules of the Provider's wellness center.
Reception service
The reception at HB is available non-stop.
Cleaning services
During stays, the Guest is entitled to have his room cleaned.
Final provisions
The provider reserves the right to change these GTC, and this change is effective for all parties from the date of their placement on the hotel website www.hotelbartos.cz.
Legal relations as well as other matters not expressly regulated by these accommodation rules are governed by the applicable legal regulations of the Czech Republic and other internal regulations of the hotel.
The consumer has the right to out-of-court settlement of consumer disputes arising from the contract through the Czech Trade Inspection (www.coi.cz).
These GTC enter into force on 1.1.2016.
